Widowed, Foreigners and Divorced by civil marriage

For those who have received the declaration of nullity from an Ecclesiastical Court

Religious certificates

Baptism

(to be requested from the church where you were baptized)

 1) The baptismal certificate on plain paper must not exceed six months from issue.

The deadline is justified by the presence of any marginal notes on the baptismal act that may alter the legal status of the nubendo/a

 2) In the impossibility of showing the certificate, because baptized abroad, a document dated before six months is also sufficient, provided that there is the sworn testimony of people worthy of faith who confirm the free ecclesiastical state of the nubendo/a.

 3) If for various reasons (e.g. destroyed church) it is not possible to find the certification of baptism, the declaration of a single witness above any suspect or the oath of the baptized person is sufficient, if he has received the baptism in adulthood.

 4) Validity and recognition. The baptism celebrated in the Orthodox, Waldensian, Methodist, Baptist, Lutheran and Anglican Churches and Ecclesial Communities is valid, and baptisms administered in the name of the SS are generally valid. Trinity.
The baptisms of Jehovah's Witnesses and Mormons are not valid, as the indispensable Trinitarian reference is missing in their rite.

 5) In completing the baptismal act, the parish priest also transcribes the marginal notes (adoptions, another marriage celebrated, declaration of nullity of marriage, ban on moving to new weddings) by transmitting the document in a sealed envelope to the parish priest who instructs the practice.

 6) The legalization of the signature of the parish priest by the Vicariate is no longer necessary for the Dioceses that are in Italy, but is required if the document is to be presented abroad..

Confirmation

(to be requested from the parish where the sacrament was received)

  1) The certificate does not expire.

  2) It is necessary to receive the sacrament before marriage "if it is possible to do so without serious inconvenience".

  3) Confirmation should not be given before marriage to married couples who live in an irregular marital situation (cohabiting or married civilly).

  4) To prove the confirmation, the confirmation certificate can be replaced with an affidavit by the interested party.

Free ecclesiastical state  Stato

(if needed)

 1) It is necessary if one of the spouses lives or has lived, after the 16th year of age, for more than a year outside the Diocese.

 2) The parish priest who instructs the practice also draws up the testimonial proof of the free state of the nubendi who, after the 16th year of age, lived in a diocese other than that in which they have their domicile.
If it is not possible to have evidence of a free state, the answers given to question number 1 of the matrimonial position are valid as a supplementary oath.

 3) For the free state of foreigners, the negative annotation in the margin of the baptismal certificate and the legal status expressed in the consular authorization are valid.

 4) For the free state of the unbaptized, the parish priest must ask the non-Catholic party for a written declaration issued by suitable witnesses certifying that she has never contracted any marriage.

Civil certificates

Extract for summary of the birth certificate
(to be requested on plain paper for wedding use in the Municipality where you were born)

 1) The certificate is valid for three months.

 2) The Italians born abroad, returning to Italy, must transcribe the birth certificate in a Municipality of the peninsula. If this has not been done, the birth certificate can be replaced with the deed of notoriety issued by the District Court.

 3) In the impossibility of having one of the four parents as witnesses in the District for the request of civil publications, in substitution of the extract for summary it is necessary to show the full birth certificate issued by the Municipality subject to the authorization of the Public Prosecutor's Office.
